1. Scope
These Terms & Conditions govern the use of the website coolgadget.ge / neewer.ge and the purchase of products offered through the website.
2. Pre-Contract Information
Before a contract is concluded, we aim to provide reliable and complete information on product characteristics, trader identity, price, payment methods, delivery restrictions, delivery terms, and the existence of statutory rights or withdrawal rights where applicable.
3. Orders and Obligation to Pay
When placing an order through the website, the customer acknowledges that the placement of the order creates an obligation to pay. Submitting an order does not automatically mean final acceptance by the merchant.
4. Order Acceptance
Final acceptance of an order may depend on stock verification, technical validation of pricing, customer confirmation, OTP verification, payment verification, or other operational conditions. If a product is unavailable or a manifest pricing or technical error exists, we may contact the customer to correct or cancel the order.
5. Prices and Availability
All prices are stated in Georgian Lari unless clearly indicated otherwise. Availability, fulfilment timing, and shipment feasibility remain subject to stock status, logistics, and verification.
6. Payment
Payment is made using the methods available on the website. Additional rules of a payment service provider may apply to a specific payment method.
7. Delivery
Delivery is governed by our Delivery Terms. The customer must provide accurate delivery and contact details. Delivery restrictions and available payment methods should be visible no later than the start of the ordering process.
8. Statutory Warranty and Defective Goods
If goods are defective, the customer may be entitled under applicable Georgian law to request repair, replacement, price reduction, or withdrawal from the contract. Repair or replacement may be refused only where impossible or disproportionate in cost under the law.
Where the law requires, repair or replacement must be provided without additional cost to the customer, including necessary delivery, labor, and material expenses.
9. Customer Responsibilities
- provide accurate, complete, and up-to-date information when placing an order;
- review the product description, compatibility details, and usage limitations before purchase;
- use the website lawfully and not interfere with its normal operation.
10. Limitation of Liability
To the extent permitted by law, we are not liable for indirect losses, delivery delays caused by third-party courier services, losses caused by inaccurate customer-provided data, or delays caused by extraordinary circumstances beyond our reasonable control.
11. Complaints and Disputes
Customers may submit complaints to sales@coolgadget.ge. If a matter cannot be resolved directly, the customer may apply to a competent authority or court in accordance with Georgian law.
12. Force Majeure
We are not responsible for non-performance or delay caused by extraordinary circumstances beyond our control, including natural disasters, technical infrastructure failures, war, civil disturbance, governmental restrictions, or similar events.
